Tim Scott Introduces Legislation to Ban Schools From Secret Gender Transitioning

Sen. Tim Scott (R-SC) on Tuesday introduced the Parental Rights Over the Education and Care of Their (PROTECT) Kids Act which would ensure that schools cannot keep a child's gender transition from parents.

The bill would require schools that receive federal funding gain a parent's permission before they change the child's pronouns or preferred name on school documents. The PROTECT Kids Act would also mandate that permission is needed for parents to allow their children to use a different bathroom from their biological gender.

“As a condition of receiving Federal funds, any elementary school… or school that consists of only middle grades… that receives Federal funds shall be required to obtain parental consent before— (1) changing a minor child’s gender markers, pronouns, or preferred name on any school form; or (2) allowing a child to change the child’s sex-based accommodations, including locker rooms or bathrooms.”

“The law in the United States has long recognized the importance of parental rights. A parent’s right to oversee the care and education of their child is guaranteed by the Fourteenth Amendment,” the bill began by adding that parents have a fundamental right to raise their children how they choose.

“Regardless of their intentions, these schools are sabotaging the parent-child relationship and encouraging children to keep secrets from the adults who are charged with protecting and defending them—their parents,” the bill read in reference to a program at Fairfax County Public Schools in Virginia that trained teachers to not receive parental permission for different names or pronouns, according to The Daily Wire.

“Children do best when their parents are actively involved in their education,” the bill explained, adding, “School districts, activist organizations, and teachers unions must never be allowed to intrude on parental rights by concealing critical information from parents about their children.”

“Schools exist to educate children — not indoctrinate them. And a quality education requires input from those who know children best: their parents,” stated Sen. Scott in a statement. “Sadly, radical and secretive gender policies have shut parents out of the conversation and broken their trust.”

“My bill will safeguard parental rights, improve the crucial relationship between parents and schools, and ensure that children can learn in an environment free from activist ideology,” the South Carolina senator explained about his bill which is endorsed by Parents Defending Education Action and Independent Women’s Voice.

The issue of elementary and middle schools overstepping their bounds on this issue has motivated parents across the country to get more involved with their local school board. The bill itself cites multiple examples of teachers and administrators going behind parents' backs.

“School staff in Montgomery County Public Schools in Maryland instruct teachers to form ‘‘gender transition plans’’ for students without the knowledge or consent of the student’s family,” the bill explained. “An Iowa public school district was sued for allowing children as young as 12 to create ‘‘gender support plans’’ without the knowledge or consent of the students’ parents.”

Parents have risen up across the country for the past two years calling out Critical Race Theory and the introduction of a woke LGBTQ+ agenda into the school system and Sen. Scott's move to prevent such indoctrination by educators is a welcome move in the right direction. 

It is all dependent, however, upon Republicans winning back Congress in the midterm elections so parents across the country need to stand up once more not at their school boards, but at the ballot box.
